• Combined passing rent: £37,500 pa
• Combined demise comprised of a large ground floor shop with rear warehouse/storage, 1st floor staff room and 3 separately accessed flats (1 x 3 bed; 2 x 2 bed)
• Previous surveyors were appointed but both retired and amicable settlement was not going to be agreed. Tenant’s surveyor had no colleague to pass on to and so recommended SW.
• Instructed late 2024 and made immediate appplication for appointment of Independent Expert.
• Report submitted Jan/Feb 2025 and expert didnt make his determination until December 2025.
• Determination – £34,850 pa – below passing so rent remained at passing by virtue of upward only drafting
• Landlord contended for £51,750 pa. Spar’s original surveyor had offered to settle at £40k, fortutantely the Landlord rejected this offer
